Drafting Step Clauses -- (in conjunction with IACCM) - Due to the upward trend in the use of multi-step alternative dispute resolution clauses in international commercial contracts, the Institute, in conjunction with IACCM, initiated a survey and research project to compare the content of these clauses and assess the effectiveness and general usefulness of step clauses. A survey was conducted of IACCM members as well as outside counsel who specialize in international commercial law and alternative dispute resolution processes. The manual and accompanying presentation incorporate the results of that survey and legal research in order to set forth best practices and model language to be utilized in the drafting and ultimate application of step clauses. |
