The question remains whether a trial in the soon-to-be Democrat-controlled Senate could delay Biden's cabinet confirmations, COVID-relief, or vaccination rollout in the early days of his presidency. "Biden will come in and will have to deal with a crisis unlike other presidents in the past that come in and they sort of, you know, they start implementing their agenda," says George Picoulas, Pace University political science professor. That would allow them to declare President Trump unfit for office and Pence would then become acting President for the final two weeks of their term. But for that to happen, the vice president would not only need to be on board but would also need a majority of the president's cabinet officials to agree the he is unfit for office in order to seize power from him. "The president can counter and say, 'No, I'm actually fine' and if he does submit that statement in writing, he maintains power of the presidency. The vice president and the Cabinet can re-counter and say, 'No, we actually believe you are unfit,’" says Pace University Professor Kiku Huckle.

We spoke with Pace University professor Kiku Huckle. She believes besides changes to education, she doesn't think much would change in terms of immigration and taxes. Those are definitely two issues very important to New York or so now Democrats, they're just waiting to see if their candidate will pull through in Georgia. If david perdue the gop candidate does win that means the senate would be still in a ditch. 

"One of the important things to remember about Biden is that he has made his name being a nice guy who's really moderate. And so there is not going to be any massive legislation changes," predicts Pace University assistant political science professor Kiku Huckle.

The tight race for president only magnifies how explosively divided the country is while in the middle of a pandemic. News 12's Samantha Crawford was on Facebook Live during election night at our Digital Desk talking to voters. Pace University Professor Kiku Huckle predicted what will happen in either outcome of the election. “Unfortunately regardless of who wins, there is a large amount of civil unrest on both sides. That is a possibility. What is certain though is that there is going to remain this great deal of polarization,” says Huckle.
