This course surveys the law and practice of aggregate litigation, covering class actions under Rule 23, multidistrict litigation, settlement design, ethics, forum coordination, and interactions with arbitration and bankruptcy. By course end, students will be able to: compare aggregation devices; apply Rule 23 certification requirements; analyze class settlements under Rule 23(e); explain the CAFA jurisdictional framework; understand MDL practice, including JPML transfer, leadership, and bellwethers; identify ethical issues for class and MDL counsel; assess arbitration's impact on aggregate litigation; draft simple class certification motions; and critique litigation strategies.
