This panel will explore the implications of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021 (EFAA) on arbitration agreements in employment. The panelists will discuss recent case law interpreting the EFAA and how that will impact companies’ ability to arbitrate sexual harassment and other employment law claims.  The conversation will also delve into novel judicial interpretations of the EFAA, which was enacted as an effort to empower survivors to bypass mandatory arbitration and pursue claims in court, but will have broader implications. Attendees will gain insights into how these developments are reshaping dispute resolution in the workplace and what they mean for employers, employees, and legal practitioners navigating complex employment claims.
